I sure hope so - that mask hurts.

ok, the question:

I am about to go and visit the nice folks over and Atlanta Triumph Ducati so they can have a looksy at my leaky cam cover, broken handbrake relay (mircoswitch) the uneven idle and continued cutting out at lights.

Yeah I know, only 2700 miles on her...

I was thinking, with the A.I. removed and my D&D's are they going to give me any guff? I mean those kind of things don't void the warranty since they were put on by an authorized dealer right?

Just seems the Jet Kit that came with the D&D's might have something to do with how it's been running...

who put it in? it's their responsibility in my view. not a warranty issue for triumph though.

That being said the other stuff (not the rough idle) ought to be covered.

If they put on the modifications than it is their baby for 2 years! If they didn't put them on than they could fairly claim that the warranty is voided.

Drew, I don't think you need to worry. My 2005 was a demo model that came from Atlanta Triumph with Predators and several other mods already installed and I know they would honor the warranty work if needed.

I beg to differ slightly on this - I believe that they can only void the warranty for related items, i.e. Triumph could easily justify voiding any warranty claim on the rough idle - but that has no effect on, for example, the microswitch which would remain covered.

I have a similar situation with my car at the moment - as I've fitted a hitch to it, BMW are whining about warranty issues related specifically to that addition, but a hitch does not have anything to with, for example, window winder motors.

My understanding is that there are numerous legal precedents on this - my memory, feeble at best, seems to think there is something called the Magnuson-Moss Warranty Act that applies. Anyone?

In the U. S. of A., the Magnuson-Moss Act prohibits a manufacturer from requiring you to only use that manufacturer's parts for repair and maintenance unless that manufacturer provides those parts and service at their expense.

Additionally, courts have denied by extention the denial of warranty based on the use of non-standard parts unless the warranting entity can demonstrate a direct causal relationship between the non-standard part and the problem addressed.

Having said all that, your best defense in an even marginally iffy warranty situation is a pre-established good relationship with your dealer. If you tick off your dealer, he will NOT represent you well in negotiating with the manufacturer.

OBTW: I believe if you read your service ticket, you'll find very limited if any warranty of the dealership's work for either legality or workmanship.

OBTW 2: An oral warranty is worth the paper its written on.

It's irrelevant whether an "authorized dealer" installed the (un)authorized parts, or some wino under a shade tree. It's whether or not the making of those changes materially contributed to the problem. If not, their presence does nothing to void a warranty on the original and unaltered parts of the machine. (Example: You install a different taillight assembly and the oil pump fails; no problem with warranty.)

The flip side of the coin is that if you have an authorized dealer install a non-Triumph accessory that somehow does screw up the rest of the bike, the mere fact that he was a dealer does not obligate Triumph to fix his mistake for you (ie, he wires the taillight assembly wrong and the wiring harness burns up; not Triumph's problem). Dealers are independent agents, not employees of the manufacturer.

I had the same worries with the warranty, whether fitting afermarket parts would affect the warranty. I asked my dealer who said it would not, but he pointed out that it was not black or white and that a dealer if he was an awkward type could refuse to repair because of this. It seems a grey area. I would check with your dealer to find out before you do mods if this will affect the warranty. You could at least, say if you engine blew up put the standard parts back on if there was going to be a problem.
