Mick, kinda is legal and kinda is not...basically they cant make up their minds about the legal term lane shifting and lane splitting. However, the road traffic act rules do (kinda) work in our favour...I put a link to them down below.
Try to make a long story short....basically I was pulling up to a set of traffic lights on a three lane road (I was in the far left lane). A car cut across the lanes, from the other-side of the road, trying to get into a petrol station and T-Boned my bike, flicking me down the road to get to know the asphalt a little better.
Turns out this car was a police car...next thing I know I'm getting booked for overtaking on the left...Then I got to go to hospital....reason, the far left lane is a marked bus lane early in the morning. (even though I was two/three car lengths away from the traffic lights..hey I could have even been turning left for all they knew)
Basically, I read the road traffic act...found Act 141 and Act 158...sent that off to the prosecutor and my infringement notice was canceled before it got to court. Why, because you can overtake on the left on multi-lane road.
Act 141 states a rider cannot overtake to the left unless;
1. The driver is on a multi-lane road and its safe to do so..(fairly vague)
2. The other vehicle (being overtaken) is turning right
3. The other vehicle is stationary and it is safe to do so. (like lane shifting to get in front of traffic)
Act 158 (this one is a winner)
It is a defense to use another lane (bike or bus) if the driver drives in the lanes for no longer than the permitted distance;
Bicycle lane 50 metres
Bus lane 100 metres.
Plus if you overtake on the right, between the cars on an broken line (in other words down the middle) it is legal and within the overtaking on the right rules. As long as done safely.
So, I now take a print out of the rules with me, so if any cop does not understand the law (and like normal drivers, they don't)...I'll just pull this out and shove it in their face. If they book me, I'll fight it in court. Mainly because getting in front of traffic when it is safe to do so is better than sitting at the lights waiting for some idiot on the phone (or doing their makeup) to come and rear end ya....plus we can get to the speed limit in around 2 seconds which takes cars a little longer...so I for one will fight any infringement notice in court...as most of the law officers would not know the law if it came up and bite em on the a$$.
