It's a trick of perspective. If you look at the reflection of the footpeg in the silencer, you can see that the mounting bracket and peg are well clear of the can.
I actually asked them about this and Carlos at TPUSA said they clear the pegs and the exhaust mounts exactly the same as the stock pipes on the Mag wheel SE.
here's a shot of mine where you can see the gap between the peg and the pipe better:
and from the rear (sorry for the crappy phone pic):
They sweep up at a steeper angle than the stock muffler, which is why I will be replacing mine with BC Sleepers, soon. I want to have room for saddlebags. I do love the sound of them, though, I hope the sleepers are comparable.
It appears you are correct.
Maybe I'm missing something (wouldn't be the first time), but I could find no listings for the Dominator Sports for any application on the TPUSA site. New Bonneville lists only the Tourings as well. Perhaps there is a supply issue. If they were discontinued, I would think someone would have heard something. Perhaps a call to Carlos is in order?
The Tourings are a fine piece of equipment (but then I'm biased), so it's not like there would be a huge sacrifice
