I had the same problem on my Legend the first time the dealer serviced it. After you drain out the extra oil pull the vent hose off that runs up to the airbox from the left side of your engine, let it drain out and then reconnect it. If you don't get the oil out of the hose it will continue to pull up to the airbox.
