I'd say you can claim that under the warranty.

Incidentally, I went through two in quick succession on the left side but never had a problem with the other one.

When I mounted the left one in a similar manner to the right, I stopped having problems. If they are mounted so that the clips are underneath the exhaust clamp as far as they will go, and then you move the shield and clamp back along the pipe so the shield is snugged up against the silencer so it can't move - then you shouldn't have any more problems.

I think that if the shield can move, then vibration can flex the clips until they fracture.
