You purchased the bike new.
And you didnt take the filter out.
That means whoever did the 500 mile service (the original dealer?) took it out, or it never had one in the first place and the servicer didn't check it.

Definite grounds for a claim against dealer/servicer I'd say!!
Someone's been negligent, and its not you (unless it was never serviced that is).
And if you won the day you could claim for a new engine!
I would!!
